Release of Liability & Medical Treatment

I release and hold harmless Swim Express LLC, its owner, and contractors/operators from any and all liability, demands, claims, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon vicinity under the control and supervision of Swim Express LLC, its owner, and contractors/operators or in route to or from any of the said premises. For the safety of all our participants, Swim Express LLC reserves the right to not allow participation in the program if they are sick or have a malady that may be contagious.

  1. I voluntarily accept any risk of damage to myself, my child, or others while taking swim lessons with Swim Express LLC. I agree to hold Swim Express LLC and its members harmless and released of liability, so I will not sue Swim Express LLC or its contractors/operators for any consequence, which includes injury, illness, and/or death (of either myself, my child, or anyone with whom I come into contact).

  2. I understand that Swim Express LLC is taking safety protocols as a measure of caution to prevent the spread of any illness, such as sanitizing equipment.

  3. In the case of illness, I agree to notify Swim Express LLC of our absence within a reasonable time prior to the start of the lesson.

  4. I give permission to Swim Express LLC, its owners, and contractors/operators to seek medical treatment for the participant in the event a parent or guardian is not able to be reached.

  5. I disclose all and any physical/mental problems, restrictions, and/or conditions of participants to Swim Express LLC its owners, and contractors/operators when deemed necessary for the safety and well-being of the participants.

  6. I give permission to Swim Express LLC, its owners, and contractors/operators to deny or terminate any and all lessons when they deem necessary (e.g. safety concerns, improper disclosure of medical conditions).

Payment for Services

I agree to purchase passes once my appointments have been booked or have enrolled into swim classes. I understand that I may request an installment plan (divided into 2 payments) if purchasing a Seasonal Swim Pass (Package of 10 Sessions).

If paying in the form of check or cash, I will notify the Swim Express Scheduling Specialist and will provide payment in full to the swim coach at the first lesson. Checks are made payable to “Swim Express LLC” and placed in an envelope with the participant’s first and last name.

I understand that Swim Express LLC does not offer refunds.

Photo & Video Release

For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby grant Swim Express LLC permission to use my child's likeness in a photograph or video recording in any and all of its publications, including but not limited to all of Swim Express LLC's printed and digital publications. I understand and agree that any photograph or video recording using my child's likeness will become property of Swim Express LLC and will not be returned.

I acknowledge that since my participation with Swim Express LLC is voluntary, I will receive no financial compensation.

I hereby irrevocably authorize Swim Express LLC to edit, alter, copy, exhibit, publish or distribute this photo or video for purposes of publicizing Swim Express LLC's programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my child's likeness appears. Additionally, I waive any right to royalties or other compensation arising out of, or related to, the use of the photograph or video recording.

I acknowledge that I may request photos and videos not to be captured or recorded from the date of my email request sent to Swim Express LLC: https://www.swimexpressfl.com/contact-us-sign-up

I hereby hold harmless and release and forever discharge Swim Express LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

Privacy Policy & Opt-in Consent

Wellness Living is the third party Swim Express LLC uses for scheduling purposes, which may be viewed here: Privacy Policy of Wellness Living Inc.

Attendance 

I will make every effort to attend lessons consistently for the success of my participant’s progress.

Instructor Cancellations:

  1. I agreed to be contacted by the instructor/lifeguard, using the contact information provided in my client portal.

  2. I acknowledge that the instructor may notify me within 30 minutes of the lesson in the case of a cancellation (e.g. inclement weather). “Weather cancellations” the day of the session are determined by the instructor/lifeguard. If the instructor cancels a session, the swim pass for that session will remain available for a future booking.

  3. I understand that in the event that there is only one participant scheduled for a Swim Together Group or a Swim Together Class, the session may be cancelled. If preferred, I may contact the Scheduling Specialist to upgrade to a private lesson.

  4. I understand that no refunds will be issued for cancelled sessions.

Participant Cancellations:

  1. If I cannot attend a scheduled swim lesson, I agree to cancel the appointment via the Client Web Portal or Achieve App at least 24 hours prior; otherwise, the swim pass for that lesson will be forfeited. I understand that no make-up passes will be provided for late cancellations (cancelled within 24-hours of the session) and that if the participant does not show up for the session, the session is considered a “no-show” appointment and will be forfeited.

  2. I acknowledge that all remaining swim passes must be used by their expiration. Unused swim passes will be relinquished after expiration. Swim pass details may be viewed in the Client Web Portal or Achieve App to review the expiration date.

  3. If I have purchased a Seasonal Swim Pass and have a consistent weekly time slot, I understand the following: If the participant cancels three weekly sessions within a four week period of time, the participant may be removed from the priority booking list for the next swim season, unless a doctor’s note is submitted to a Swim Express Scheduling Specialist explaining a medical leave.

  4. I acknowledge that no refunds will be issued for cancelled sessions.

Pool Temperature (Cooler Months):

To ensure my or my child’s health and comfort, I agree to heat the pool’s temperature to 85 degrees Fahrenheit or warmer in the cooler months. Swim Express LLC requests that I keep track of the pool’s temperature—in the event of an outside temperature below 70 degrees coupled with a pool temperature below 85 degrees, I will cancel the session in the client portal at least 24 hours prior to the lesson.

If the pool is too cold for the participant’s health, the session will be forfeited.

Pool Cleanliness:

If a home pool is used for swim lessons, I understand that I am responsible for maintaining safe chlorine levels and keeping the pool clean and sanitary.

If the pool is not up to water safety standards, the session will be forfeited. Alternatively, the client may find a different pool location if the schedule allows.

Swim Attire:

All participants must wear proper outfits that are designed for swimming. During the cooler months, a long-sleeve wetsuit may be recommended but not required for younger children. Recommendations include O’Neill wetsuit or the Neoprene Wetsuit. Note: Swim Express is not sponsored by or affiliated with these brands.

Young children who are not trained to use the restroom must wear two swim diapers under their swimming suit. We recommend using hair ties or swim caps for children with long hair so that hair does not obscure the participant’s vision.

Goggles are recommended for more advanced levels of swimming. Recommendations include TYR Goggles or SPEEDO Goggles. Note: Swim Express is not sponsored by or affiliated with these brands.
